SECOND AMENDED
DECLARATION OF COVENANTS,
CONDITIONS, EASEMENTS AND RESTRICTIONS FOR
HANOVER ESTATES SUBDIVISION IN MANHATTAN, ILLINOIS
THIS SECOND AMENDED DECLARATION of Covenants, Conditions, Easements and
Restrictions for Hanover Estates Subdivision (the "Declaration") made this 7th day of May, 2007, by William J. McEnery, not individually, but as Trustee under Trust Agreement dated April 22, 1993, and known as the William J. McEnery Revocable Trust ("Declarant"). This Second Amended Declaration shall replace in its entirety that certain First Amended Declaration recorded in the Office of the Recorder of Deeds of Will County on September 14, 2006, as document No. R2006-155114.
RECITALS
A. Declarant is the record owner of certain real estate legally described on Exhibit A, attached hereto and by this reference made a part hereof, which proposed development is commonly known as Hanover Estates Subdivision Phase 1 and Phase 2 (the "Property" or “Subdivision” or “Hanover Estates”.
B. Manhattan Property Development, Inc., an Illinois Corporation, is the Developer herein ("Developer").
C. This Declaration sets forth covenants, conditions, easements and restrictions with regard to the Lots in Hanover Estates.
D. Developer intends to submit the Property to the provisions of this Declaration and to form an Illinois not?for?profit corporation known as Hanover Estates Homeowners Association, Inc. for the purpose of owning, maintaining and administering certain portions of the Property (as defined herein) and the facilities and improvements thereof, as hereinafter provided.
NOW, THEREFORE, Declarant, his, her, their, its successors and assigns, hereby declare that all of the Property shall be held, sold and conveyed subject to the following covenants, conditions, easements and restrictions, all of which shall run with the land and be binding on all parties having or acquiring any rights, title or interest therein or any part thereof, and shall inure to the benefit of each Owner thereof.
